ABD Partner, Michael Merrill, and Associate, Yolanda Martinez, obtained a favorable trial result in Orange County against a well-known Plaintiff’s firm. The case involved a rear-end accident where liability was disputed. The Defendants asserted the Plaintiff abruptly stopped his vehicle, contributing to the accident, and the Plaintiff asserted he had no fault for the accident. The Plaintiff’s treatment included chiropractic care, diagnostic studies, and pain management procedures, including injections and a radiofrequency ablation. The jury determined the Plaintiff was equally at fault for the accident and the Plaintiff did not sustain a permanent injury. The jury also awarded past medical bills for an amount below the Defendants' suggestion. Following post-trial motions, the net judgment should be a complete defense verdict. The Defendants are also entitled to recover their attorneys' fees and costs under an expired Proposal for Settlement.
