The Plaintiff alleged ABD's client damaged a private roadway as a result of commercial equipment staging. Through discovery, it was ultimately established the Plaintiff could not support her theory of liability and would have to impermissibly stack inferences to prove her case. In addition, it was argued the Plaintiff had failed to include other residents of the community, who would be indispensable parties to the action. The Court agreed with both of the defense arguments. The client is thrilled with the outcome and will be entitled to recover their defense expenses against the Plaintiff.
