ABD Partner, Michael Merrill, and Associate, Asma Patel, obtained a summary judgment in favor of a national retailer. The Plaintiff slipped and fell after another customer dropped a bottle of wine. As a result of the fall, the Plaintiff fractured her knee and had medical bills in excess of $100,000. Through depositions, it was established the Defendant’s employee had also heard the wine bottle break and began walking towards the area of the sound. When the Defendant’s employee arrived to the area, he observed the broken bottle and began calling for assistance with the spill. Seconds later, the Plaintiff passed through the area and fell. While there was evidence the Defendant’s employee had actual notice of the broken wine bottle, the Court agreed the Defendant’s actual notice of the condition was for an insufficient amount of time to remedy the condition and, therefore, the Defendant did not breach the duties it owed to the Plaintiff. The client is obviously thrilled with the outcome and will be entitled to recover their defense expenses.
